Finally a court of appeal decision finding that the Defense of Marriage Act is unconstitutional to ban marriage of same sex couples in states that have approved such.
This decision should remind us all that here was clearly no rational grounds for Proposition 8. During the trial, opponents of gay marriage could not articulate any sort of ways in which such marriages would damage those of heterosexual couples, one of the claims made by the defense. The defense's other contentions -- that heterosexual couples make superior parents and that the function of marriage is responsible procreation -- also fell apart under the lightest examination.
The fact that now a Federal Court has decided that at least sections of DOMA are unconstitutional is severe blow to opponents of same sex marriage. It is just a matter of time before the courts decide that states are unable to pass legislation banning same sex marriage.
